Cropped - Branch into the window - With text captions at window's depth

Same photo, only with some texts.
Is there Window Violation?

In the message which led to this post, I understood that the statement "Now, if we make it absolutely clear tat the frame is flat - by adding captions, for instance - the violation becomes all too apparent!" was a reference to captions added under/over the image (by opposition to inside as here) as indirectly mentioned a bit earlier in the thread.
This image modified with the captions above and under the "content" (and particularly above here), would anchor the window more strongly in depth and then the conflict between the depths of the top border and the tree that is occluded by it would also be stronger.
Of course, displaying text like this is a total non-sense, and it is a problem with subtitles in 3D movies.

Yes, the upper text behind the branch makes a conflicting view. But I would not call it "Window Violation", it is rather a retinal rivalry produced by the text.

Yes it has the same window violation as before. Only now it's even more disturbing as the tree at the top is colliding with the text. At the top where says "depth" the tree intersects the text.
